Bills that may affect the betting market

The regulation of sports betting awaits presidential sanction, after having been approved by both the Chamber of Deputies and the Federal Senate .

With the sanction, Bill No. 3,626 will become law and will bring rules for the sector, including points such as taxation for both companies and bettors.

This bill, however, was not the only one to address betting. Other bills that address specific aspects of the sports betting sector are being processed in the Senate and the Chamber of Deputies and may affect the lives of bettors.

Among them, there are projects that bring changes to advertising rules, guidelines to prevent manipulation of results in sports games and even the permission of physical casinos in Brazil.

Animal game

Bill No. 2,234 was introduced in the Senate in 2022 and is awaiting assessment by the Constitution, Justice and Citizenship Committee (CCJ) in order to move forward.

The text modifies the Law on Criminal Offenses, legalizing modalities such as animal gambling, casinos and bingo.

According to the Bill, “the practice and exploration of games and bets may occur in a physical establishment upon prior obtaining, by the interested party, of acts of consent from the public authorities”.

The Bill determines general rules for the exploration of this market, including rights and prohibitions for bettors, guidelines for advertising and responsible gaming practices.

The matter is reported by Senator Irajá in the CCJ, which issued a report in favor of approval. The text was even on the agenda in November 2023, but was not discussed.

Also in progress, PL 442/1991 was approved by the Chamber of Deputies in 2021. The text also defines rules for the operation of bingo and other betting games such as jogo do bicho .

The project awaits Senate review, a process that has not yet begun.

Manipulation of results

Bill No. 2,667 of 2023 aims to increase the penalties provided for fraud, alteration or falsification of the results of a sports competition , in the case of the intention to obtain a financial advantage in gambling or bets of any nature, including lotteries.

The idea of ​​the project is to apply double penalties in the case of manipulation of results.

The author of the project, Senator Jorge Kajuru, justified the importance of the PL by citing cases of fraud in Brazilian sport and Operation Maximum Penalty .

The text has already been approved by the Senate Sports Committee (Cesp) and is awaiting consideration by the CCJ, where it does not yet have a rapporteur.

Electronic games

Already approved by the Chamber of Deputies, Bill No. 2,796, of 2021, creates the legal framework for the electronic games industry and for fantasy games, the so-called Fantasy Games .

The tehttps://apostalegal.com/guias/o-que-sao-fantasy-gamesxt has already been approved by the Senate’s Economic Affairs Committee (CAE) and was even discussed in the Plenary, but ended up returning to be discussed by the Education and Culture Committee (CE).

The project’s rapporteur in the committee, Senator Leila Barros issued a report in favor of approval in December 2023, but removing Fantasy Games from the text, as she considers them to already be covered by PL 3,626, which deals with the regulation of fixed-odds bets.

Betting on individual events

Still amidst the match-fixing schemes in football, another bill currently being processed brings changes to the betting market.

Bill 2,842 prohibits sports betting on individual actions during sporting events and establishes regulations for betting on the number of goals and match results.

According to the text, the ban on betting on individual actions, such as yellow cards, red cards, corners and fouls, aims to avoid possible manipulation and negative influences during games.

The project awaits a vote in the Sports Committee of the Chamber of Deputies (Cespo), where it is reported by deputy Maurício do Vôlei.

The deputy issued a report in favor of approval and, although the topic has already been discussed, it has not yet been voted on.

Still in the Chamber, the project will still need to pass through the Finance and Taxation Committee (CFT) and the Constitution and Justice and Citizenship Committee (CCJC).

Influencer advertising

Cases involving digital influencers advertising games such as the tiger game and the airplane game have become popular and have been investigated by the police.

It is in this context that PL 3.915 prohibits the disclosure, promotion or endorsement of betting companies, casinos in general, gambling or any activities related to betting, by digital influencers and artists.

The project is in the Chamber of Deputies and has already been approved by the Communications Committee (CCOM). It will still need to pass through the CCJC before going to the plenary.

Age verification

Bill No. 4,999 aims to establish mandatory age verification systems on sports betting websites and websites selling adult content.

The text, by congressman Filipe Martins, amends the Internet Civil Rights Framework. In his justification, he states that the project aims to extend the use of identification technologies already used by the banking sector to protect children and adolescents.

The project was received by the CCOM of the Chamber of Deputies, but a rapporteur has not yet been appointed.

Physical casinos

Bill No. 5,433 provides for the exploration of casino activities throughout Brazilian territory.

The text allows the exploration of casino activities throughout the national territory, as an instrument of social and economic development and promotion of work.

The project establishes that casino activities may be operated exclusively in hotels, historic hotels or resorts , including machine limits for each type of establishment.

In the Chamber, the project will still have to pass through the Tourism Committee (CTUR), Economic Development Committee (CDE), CFT and CCJC. None of these votes have yet begun.
